Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and HeyPao ("HeyPao", "we", "us", or "our") and govern your access to and use of the HeyPao mobile application, our website at pao-app.com, and any related features or services (together, the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

The short version. HeyPao is an AI race-pace planning app for runners. You must be old enough to use it, keep your account secure, and use the Service responsibly and lawfully.

Our pacing plans are informational only and are not medical advice — always train and race within your own limits and consult a professional. You keep ownership of what you post but give us permission to display it so the Service works. The Service is provided "as is", and our liability is limited as described below. Questions? 1. Acceptance of these Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and any policies referenced in them. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" refers to both you and that organisation.

2. Who can use HeyPao

You must be at least 13 years old to use the Service. In some regions the minimum age may be higher, and if you are under the age of majority where you live, you may use HeyPao only with the consent and involvement of a parent or guardian who agrees to these Terms. You may not use the Service if you are barred from doing so under applicable law or have previously been removed from the Service.

3. Your account

To use most features you must create an account with accurate information and keep it up to date. You are responsible for your account credentials and for all activity that happens under your account. Keep your password confidential, and notify us promptly at support@pao-app.help if you suspect any unauthorised use. You may delete your account at any time from Settings → Delete My Account in the app.

4. Licence to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the Service for your own non-commercial use. You may not sell, sublicense, rent, or otherwise commercialise the Service or any part of it, except as expressly permitted by us in writing. All rights not expressly granted are reserved by HeyPao.

5. Acceptable use

You agree not to:

Use the Service in violation of any applicable law, regulation, or third-party right.
Interfere with, disrupt, overload, or attempt to gain unauthorised access to the Service, other users' accounts, or our systems or networks.
Reverse engineer, decompile, scrape, data-mine, or copy any part of the Service except as permitted by law.
Upload or transmit malware, or use bots or automated means to access the Service without our permission.
Post or share content that is unlawful, harassing, hateful, defamatory, deceptive, infringing, obscene, or that violates others' privacy.
Impersonate any person or entity, or misrepresent your affiliation with anyone.
Use the Service to send spam or unsolicited promotions, or to collect other users' information without consent.

We may investigate and take appropriate action, including removing content and suspending or terminating accounts, for any violation.

6. Your content

"Your content" means anything you submit to the Service, such as your profile details, photos, posts, comments, messages, and race data. You retain ownership of your content. By submitting it, you grant HeyPao a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, modify (for formatting and display), and display your content as needed to operate, provide, and improve the Service, consistent with your privacy settings and our Privacy Policy.

You are solely responsible for your content and represent that you have the rights to submit it and that it does not violate these Terms or any law. We are not obligated to store your content and may remove content that violates these Terms.

7. Community & social features

HeyPao includes social features such as profiles, following, an activity feed, comments, and messaging. Be respectful of others, and remember that content you make visible may be seen, saved, or re-shared by other users according to your settings. You may block other users and report content or behaviour that violates these Terms. We may moderate, limit, or remove content and accounts to protect the community, but we are not responsible for content created by users.

8. Purchases & subscriptions

HeyPao is currently free to download and try. We may offer optional paid features or subscriptions ("Premium") in the future. If you purchase Premium through the Apple App Store, the following applies:

Payment is charged to your Apple ID account, and your subscription automatically renews for the same period unless you cancel at least 24 hours before the end of the current period.
You can manage or cancel a subscription in your App Store account settings; deleting the app does not cancel a subscription.
Except where required by law or by Apple's policies, payments are non-refundable, and partial periods are not refunded.
We may change prices or features, and where required we will give you advance notice and the chance to cancel.

9. Pacing plans & health disclaimer

HeyPao generates race-pacing plans and related insights for informational purposes only, based on the data available to us. They are not medical advice and are not a substitute for professional coaching, medical advice, diagnosis, or treatment. Running and racing carry inherent risks. Always consult a qualified healthcare professional before starting any training programme or attempting any race, listen to your body, follow official race rules and cut-offs, and stop if you feel unwell. You assume all risk arising from your training, your participation in any race, and your use of the pacing plans.

10. Third-party services

The Service integrates with or links to third parties — for example Strava, race organisers, app stores, and cloud providers. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. If you connect a third-party account (such as Strava), you authorise us to access and use the information you approve, and you can disconnect at any time.

11. Intellectual property

The Service, including its software, design, text, graphics, logos, and the "HeyPao" name and marks, is owned by HeyPao or our licensors and is protected by intellectual-property laws. Except for the limited licence in Section 4, these Terms do not grant you any right to our intellectual property, and you may not use our name, logo, or branding without our prior written permission.

12. Feedback

If you send us suggestions or feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use it for any purpose without any obligation or compensation to you.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to those practices.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if we believe you have violated these Terms, to protect the Service, our users, or third parties, or if required by law. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and dispute terms — will survive.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR ACCURATE, OR THAT ANY PACING PLAN WILL ACHIEVE A PARTICULAR RESULT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE MAY NOT APPLY TO YOU.

16. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HEYPAO AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR FOR ANY PERSONAL INJURY OR HEALTH CONSEQUENCES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 50. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT FULLY APPLY TO YOU.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless HeyPao and its team from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your content, your use or misuse of the Service, or your violation of these Terms or any law or third-party right.

18. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which HeyPao is established, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence give you additional protection. Before bringing any formal claim, you agree to first contact us at support@pao-app.help so we can try to resolve the matter informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the competent courts of HeyPao's home jurisdiction, unless applicable law requires otherwise.

19. Apple App Store terms

If you download HeyPao from the Apple App Store, you acknowledge and agree that:

These Terms are between you and HeyPao only, not with Apple, and Apple is not responsible for the Service or its content.
Apple has no obligation to provide any maintenance or support for the Service.
If the Service fails to conform to any applicable warranty, you may notify Apple for a refund of any applicable purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation regarding the Service.
Apple is not responsible for addressing any claims relating to the Service, including product-liability, legal/regulatory, or consumer-protection claims, or any third-party claim that the Service infringes intellectual-property rights.
You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list, and that you will comply with the App Store Terms of Service.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

20. Changes to the Service & these Terms

We are continually improving the Service and may add, change, or remove features at any time. We may also update these Terms from time to time. When we make material changes, we will post the updated version with a new "Last updated" date and, where appropriate, notify you in the app or by email. Your continued use of the Service after an update means you accept the revised Terms.

21. General terms

These Terms, together with our Privacy Policy and any other policies we reference, are the entire agreement between you and HeyPao regarding the Service. If any provision is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent, but we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any failure or delay caused by events beyond our reasonable control.
